論網際網路言論活動之規範:法律經濟分析觀點

 

On the Regulation of Speech in Cyberspace: An Economic Perspective

摘要

目前我國政府對於網際網路言論市場的管理,大致上可以分為二個面向,第一個面向是從言論提供者著手,以電腦網路內容分級制度為主,第二個面向從言論接收者著手,以的台灣學術網路不當資訊防制計劃為主。本文嚐試以Richard Posner所提之成本效益分析方式,比較分析上述二種網際網路言論活動管制模式,發現阻礙言論接收者接收某些特定資訊是較好的,因為此種做法較不會產生以腳投票的現象或是減少資訊的提供。其次,針對澳洲、歐盟和美國的法制進行研究,發現該等法制,尤其是美國所採取的途徑,係如實地反映出阻礙言論接收者的接收某些特定資訊是較好的,因為此種模式對於網際網路言論供給的影響較小。我國雖有執行電腦網路內容分級制度,又或台灣學術網路不當資訊防制計劃,但是本文建議宜加強對民眾的宣導,使民眾注意到兒童安全上網的問題,並教導民眾藉由科技來防止兒童接取網路不當資訊。

Abstract

There are two approaches on regulations of speech in cyberspace in Taiwan. One is regulation on the supply side, namely Internet Content Rating Mechanism; the other is regulation on the demand side, namely Preventing Improper Information from TANet Plan. With the costs and benefits analysis, it is found that preventing speech receivers from specific information is much better because it would not discourage the supply of speech. The approaches adopted in Australia, European Commission and America may support this argument. It is recommended that we shall make the public aware of the Internet safety issues, and encourage them to employ the technology (such as filters) to prevent children from accessing the improper information in cyberspace.
